Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of Rivet Atlas (the "Platform"), including https://iwantcashoffers.com and related staff applications, operated by Rivet Real Estate("Rivet," "we," "us," or "our"), a Texas-based real estate brokerage and services organization. By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2. Services

The Platform provides tools operated by Rivet for team workflows and client services, including property intake (cash-offer requests), seller status tracking, listing management, market analysis, and client communications. Features may change, be added, or be discontinued at any time. Rivet does not guarantee availability, accuracy, or completeness of any output generated by the Platform.

3. Eligibility & accounts

• Public users may submit property inquiries and track request status using contact information they provide.
• Staff users must be invited by Rivet and authenticate with credentials we issue. You are responsible for safeguarding login credentials and for activity under your account.
• You represent that information you submit is accurate and that you have authority to submit it.

4. Communications & consent

Rivet will not send marketing or transactional communications on your behalf without appropriate consent. By submitting a cash-offer or contact form, you may opt in to be contacted by Rivet via call, email, or text regarding real estate services, subject to applicable law. You may opt out of text messages by replying STOP. Message and data rates may apply. Staff-initiated outbound messages through the Platform require human review and explicit send action - the Platform does not auto-send client communications without authorization.

5. Client data protection

The Platform may process client, property, and transaction information submitted by you or Rivet staff. Staff users must handle such data in accordance with Rivet policies, applicable brokerage regulations, and fair housing laws. You may not disclose client data except as authorized or required by law. Unauthorized access, scraping, or exfiltration of Platform data is prohibited.

6. MLS & third-party data

Property listings, comparables, and market data displayed or derived through the Platform may originate from MLS feeds, public records, or third-party providers. Such data is provided for brokerage operations and client service only. You may not redistribute MLS or licensed data except as permitted by the applicable MLS rules and license agreements. Rivet makes no warranty as to the timeliness or accuracy of third-party data. Display of MLS identifiers (where shown) does not constitute an endorsement by any MLS.

7. Acceptable use

You agree not to:

• Violate any law, MLS rule, or third-party rights;
• Probe, disrupt, or attempt unauthorized access to the Platform;
• Upload malware or interfere with Platform operation;
• Use the Platform to harass, discriminate, or mislead clients or counterparties;
• Reverse engineer or copy the Platform except as permitted by law.

8. Intellectual property

Rivet and its licensors own the Platform, branding, and underlying software. These Terms do not grant you ownership of any Rivet intellectual property. Content you submit remains yours; you grant Rivet a license to use it to operate and improve the Platform and provide real estate services to you.

9. Disclaimers

The platform is provided "as is" and "as available." To the maximum extent permitted by law, rivet disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing on the platform constitutes legal, tax, or investment advice. Real estate decisions should be made with qualified professionals.

10. Limitation of liability

To the maximum extent permitted by Texas law, Rivet and its officers, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Platform. Our aggregate liability for any claim relating to the Platform shall not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) amounts you paid Rivet for Platform access in the twelve months preceding the claim, if any.

11. Indemnification

You agree to indemnify and hold harmless Rivet from claims arising out of your misuse of the Platform, violation of these Terms, or infringement of third-party rights.

12. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Exclusive venue for disputes shall be state or federal courts located in Travis County, Texas, unless otherwise required by applicable law.

13. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use after changes constitutes acceptance.
